Terms of Use

These Terms of Use ("Terms") govern your use of the Mimu app and related services ("Mimu", "we", "us"). By creating an account or using Mimu, you agree to these Terms. If you do not agree, do not use Mimu.

1. Who can use Mimu

You must be an adult (18 or the age of majority in your country). Mimu is for parents and legal guardians: you may only add photos of a child if you are their parent or legal guardian, or if their parent or legal guardian has authorised you to do so. You are responsible for keeping access to your account secure.

2. Your account

You can use Sign in with Apple, or sign in with a one-time code or link sent to your email address. You may delete your account at any time from the app (Settings). This deletes your children’s profiles, photos and portraits.

3. Portrait sessions

Mimu uses artificial intelligence to create portraits of your child as the character and in the scene you describe. Results are generated automatically and may vary. A session includes one round of adjustments for up to two portraits. Some requests may be refused by our AI provider’s safety systems. When this happens, we will let you know and return the session to your account. Portraits are AI-generated images and include provenance metadata identifying them as such.

4. Packs and payments

Sessions are sold in packs through Apple’s App Store as consumable purchases. Prices are shown in the app before purchase, in your local currency. Payment is charged to your Apple Account when you confirm your purchase. A session is used when you request it and is returned automatically if no portraits are delivered. Unused sessions remain in your account for as long as the account exists. They have no cash value and cannot be transferred. Refunds are handled by Apple in accordance with its policies. If Apple refunds a pack, the sessions added by that pack are removed from your account (any portraits already delivered remain yours).

5. Acceptable use

You agree not to: upload photos of a child without the authority described in section 1; upload photos of adults or anyone other than the child whose profile it is; request sexual, violent, hateful or otherwise harmful content, or content that sexualises or endangers children; use portraits to deceive, harass or impersonate anyone; attempt to access other people’s accounts or data; reverse-engineer or disrupt the service; or use automated means to access it.

6. Your content and the portraits

You retain ownership of the photos you upload. You grant us a limited licence to store and process them solely to provide the service to you, as described in the Privacy Policy. Subject to these Terms and the rights of others, you may use the portraits created for you for personal, non-commercial purposes, such as keeping or printing them, or sharing them with family and friends. When you request a character or work that belongs to someone else, you are responsible for using the portraits in a way that respects those rights.

7. Community and feedback

The feedback area (Community, Ideas, Bugs) has its own Community Guidelines, which you must accept before posting. Never post photos of children or information that could identify a child. We may moderate, hide or remove content, and suspend posting privileges for anyone who breaches the guidelines. Contribution rankings and medals are symbolic and have no monetary value.

8. Changes and availability

We may update Mimu and these Terms. We will notify you in the app of any material changes. We aim to keep Mimu available but do not guarantee uninterrupted access.

9. Disclaimers and liability

Mimu is provided "as is" to the extent permitted by law. To the fullest extent permitted by applicable law, we are not liable for indirect, incidental or consequential loss or damage. Nothing in these Terms limits any rights you have under mandatory consumer protection laws in your country.

10. Termination

You may stop using Mimu at any time. We may suspend or terminate accounts that breach these Terms.

11. Law and contact

These Terms are governed by the laws applicable in your country of residence where required by mandatory law. Questions: support@mimumagical.xyz.
